Once we get our teams franchised any and all Business members can post pics of OUR teams. Reg, you can post any pics of the HiTMEN and MAULERS on your WEB-SITE. When you get your web-site up again let me know. I will e-mail you pics of the teams. LETS GO. We are being challenged by THE MAN. I am pumped UP now. One of our members is being screwed with. It's time for all of us to stick together. We preach UNITY so lets see it

The hobby is struggling to exist as it is. If it is truly our goal to keep the hobby alive and advancing, it is not wise to attack other members within it. Moreover, this type of behavior is silly given the nature of this hobby. When you look at it for what it is, it is plastic. Imagine a news report talking about a murder. The motive of the murder was someone wanted to control the electric football industry. Imagine going to prison for killing someone over electric football. Imagine telling someone what you were arrested for. Imagine how it would look to tell someone outside of the hobby that you play electric football and they know about the murder that took place concerning it. You would look stupid. Madoff is going to prison over billions of dollars. Your dumb a** is in prison over electric football… Think about it.
I have an idea who did this to Reggie. Since I have no proof, I won’t say any names. It is one thing I know for sure. This attack on Reggie came from an adult. I say to the element that is determined to have this hobby for themselves you’re weak, your mentality is poor and you are stupid. There is no real revenue in this hobby. Even if you had it all to yourself, you still wouldn’t get paid. Maurice The Electric Coach

The No Fun League
I have often wondered how and why the NFL chooses the battles it does. I would guess that based on past displays of logos and copyrighted/trademarked material that they probably have a careful eye on some on the hobby.
On the one hand we want more publicity (as should the NFL) and on the other hand, the NFL, NFLPA is extremely stringent on who and how licenses are granted so if people are making $ off "likenesses" or are making $ off decals, stadiums, etc do they have a right to intervene? We're small potatoes and unfortunately they go after a guy like Reggie or George when something is brought to their attention or perhaps they're doing ongoing web searches, etc. I'm a bit torn on this one as I can't say that they don't have the right to enforce something but at the same time things should be enforced universally in that case. One thing that would be interesting at our convention would be a panel of a couple legal people to discuss patent and copyright law and how it relates to what we can and can't do. I actually know a good lawyer in Canton who specializes in patent and copyright law as he is the husband of our former nanny and they moved from MSP to Canton. I've always wondered where the line is drawn? |

Tom,
The NFL's trademark would be their logos, shields, names ie. Pittsburgh Steelers and their likeness. Example, if you took the Raiders logo and switched the eyepatch on the logo it would still be an infringement on the logo. The NFL has this thing all rapped up. There is no way around it. |

I'm aware of a decent amount of the licensing stemming from the research done into a possible business venture a few years back. The NFL owns all their logos, uniform design, etc. Think of that as the "team" piece. A Cowboys or Packers logo on a midfield of a stadium...technically you couldn't use that and generate any $ from it without giving the NFL a piece.
The "likeness" comes in with the NFLPA. Anytime you are generating $ from a player's likeness (such as the video games), their names, their signature traits, etc...the NFLPA has a right to ask for their cut. Deals can be done with individual players or blanket deals, such as the video games using likenesses and names. Technically, anytime you decal up a figure and then sell it, you risk violation of both the NFL and the NFLPA licenses as you're likely using NFL logos on the uniform and the player's jersey name and likeness of look. If I want to take unpainted figures and paint some up for my own collection, I honestly don't know what the law would say. As an artist, I suppose I could do whatever I want as long as I wasn't selling it to others. I'm sure Jennings and others can add even more to this thread as they've dealt with it more. I do think it'd be an interesting session in Canton. |
