Legal Disclaimer and MFCA Code of Conduct
The MFCA is a 501c7 not-for-profit organization the purpose of which is to promote the hobby of miniature football and to encourage participation of coaches across the country. In doing so we encourage our members to post and display their various teams, collections and related materials. Some of these items may be for sale to the general public. The sale of such items does not benefit the MFCA directly and the MFCA has no interest in nor legal liability for said sales or transactions.
The MFCA shall not be responsible for or in any way liable for the content of images, web sites, web links or any other information furnished by any of its members, companies or corporations. Said liability to include defamation in any form, copyright, trademark or patent infringement, license violations or other legal theories. Members, companies and corporations acknowledge and agree that they are SOLEY responsible for the content of writings and or images they may post on this site. That posting images and writings may expose them to legal liability such as trademark and copyright infringement, licensing violations and other legal theories. And by posting these images and or writings they acknowledge and agree to be responsible for any and all damages, costs and legal fees associated with the MFCA's defense or any legal action that may result from said postings. Should the MFCA be named or involved in any legal action as the result of information supplied by any of its coaches, members or organizations, said coaches, members or organizations shall indemnify the MFCA and hold it harmless for all damages, interests, costs and attorneys' fees incurred as a result of such claims. The MFCA Board of Directors hereby enact the following Code of Conduct for all MFCA and forum members as it relates to posting on this forum. This will be strictly enforced. Each member shall abide by the COC or face the consequences as stated below. MFCA Code of Conduct (COC) Each dues paying member of the MFCA shall conduct themselves in a manner that upholds the tenants of the MFCA mission statement, unity, fellowship and integrity. This shall include good sportsmanship and proper behavior as deemed fitting by the accepted norms of society. Any incident deemed to be outside of those norms as judged by the MFCA Board of Directors (BOD) will be acted upon in the following manner. For violating the MFCA COC First offense: The offending member will serve a 60 day suspension from the MFCA and from viewing or posting on the forum. Second offense: The offending member will be expelled from the MFCA and its forum and may not rejoin the MFCA or participate in MFCA sponsored events and contests for one (1) calendar year. Reinstatement of a Banned Member: Any person who has been expelled from the MFCA shall have the opportunity to re-apply for membership after one (1) calendar year. The Board of Directors will review and consider the grounds for expulsion, the expelled person's conduct since expulsion, the effect of reinstatement on current members as well as the MFCA’s good name, well-being, and any other mitigating or aggravating circumstances which may be presented for the consideration of the Board of Directors upon an expelled person's application for reinstatement. The Board of Directors will at that time determine, by a majority vote, whether to re-admit the expelled person. If reinstatement is denied, the expelled member may make a second application after two (2) calendar years have elapsed from denial of the initial application for reinstatement; and should that second application for reinstatement be denied, the expelled member may apply for reinstatement every five (5) calendar years thereafter. The Board of Directors will, for every received application for reinstatement that is allowed per the above, determine, by a majority vote, whether to re-admit the expelled person. If the Board of Directors does permit reinstatement for an expelled individual, the expelled individual shall be on a one year probationary period. If the expelled individual is involved in any subsequent INCIDENT of INAPPROPRIATE CONDUCT during the probationary period, an automatic lifetime ban shall be imposed on the expelled individual. |
